Programs & retreats1) Acceptance of Terms
These Terms govern your access to this website, mailing list, classes, groups, events, digital products, and professional services provided by Mark Arcuri, PhD (“we,” “us,” or “our”). By visiting, registering, purchasing, or booking, you agree to these Terms.
2) Who We Are
We provide professional services including psychological assessment (New Mexico only) and coaching (available in New Mexico, elsewhere in the US, and worldwide), plus workshops, retreats, courses, and digital resources that support personal development and alignment.
3) Scope of Services
3.1 Psychological Assessment (New Mexico)
- Assessment services are available to clients physically located in New Mexico at the time of service and follow applicable professional standards and regulations.
- Psychological assessment is distinct from psychotherapy and from coaching.
3.2 Coaching (New Mexico, Elsewhere in US & Worldwide)
Coaching supports clarity, alignment, and action toward personal goals. It is not psychotherapy, counseling, medical, or legal advice. Coaching may include mindset tools, reflective practices, accountability, psychoeducation, or skills‑building.
3.3 Other Offerings (Groups, Courses, Events)
Offerings may include their own descriptions, pricing, schedules, and eligibility requirements posted at purchase or registration.
4) Not Medical, Emergency, or Legal Advice
- Coaching and educational materials are for personal development and do not diagnose, treat, or prevent medical or mental health conditions.
- Always consult a qualified provider regarding your health or mental health.
- If you are in crisis, call your local emergency number (e.g., 911 in the U.S.) or go to the nearest emergency department immediately.
- Nothing here constitutes legal, financial, or other professional advice.
5) Client Responsibilities
Participation & Information
- Provide accurate information and keep contact/billing details up to date.
- Engage actively and complete requested forms or questionnaires.
- Ensure a private, quiet space and sufficient internet for virtual sessions.
Compliance Where You Are
- You are responsible for ensuring it is lawful to receive services where you are physically located at the time of service.
6) Scheduling, Cancellations & Lateness

Rescheduling/Cancellation: Please provide at least 24 hours’ notice. Late cancellations or no‑shows may be charged up to the full session fee.

Lateness: Sessions end at the scheduled time; arriving late may reduce your time without reducing the fee.

Our cancellations: We may reschedule or cancel for illness, emergencies, or events beyond our control, with reasonable notice and options to rebook or receive a refund where applicable.
7) Fees, Refunds & Payment
Pricing & Changes
Current fees appear at booking/checkout and may change prospectively.
Refunds
Unless a written guarantee applies to a specific product/event, fees for coaching and assessment are generally non‑refundable once the session or service window begins.
Payments
We accept common electronic payments via our processors. By paying, you authorize charges for due amounts, taxes, and fees.
8) Confidentiality & Privacy
- We respect your privacy. See our Privacy Policy for how we handle personal information.
- Psychological assessment confidentiality follows professional standards and law.
- Coaching confidentiality is maintained to the extent allowed by law; coaching is not clinical care and is not regulated as health care.
- We may disclose information when required by law or to prevent imminent harm.
9) Telehealth & Cross‑Border Clients
- Most sessions are virtual. Ensure services are lawful where you are located at the time of service.
- For psychological assessment, you must be located in New Mexico unless otherwise permitted by law and explicitly agreed.
- Technology failures can occur; if a session drops, we’ll attempt to reconnect or reschedule.
10) Groups, Courses, Programs & Events
- Group settings are educational/supportive, not therapy. Keep discussions respectful; do not share others’ information outside the group.
- Live sessions may be recorded for participants or internal quality/training; notice will be provided when recording occurs.
- Access to course materials is personal and may be time‑limited as stated at purchase.
11) Community Guidelines
- We welcome diverse perspectives. Harassment, hate speech, or disruptive behavior may result in removal without refund.
- Do not post or transmit content that is unlawful, defamatory, or infringes others’ rights.
12) Intellectual Property
All site, course, and session materials—including text, graphics, video, downloads, and frameworks—are owned by or licensed to us. You receive a personal, non‑transferable license to view/use content for individual purposes. Do not reproduce, distribute, modify, or create derivative works without written permission.
13) Testimonials & Outcomes
Testimonials reflect real experiences of individual clients; results vary. We do not guarantee outcomes. Your progress depends on many factors, including your effort, circumstances, and follow‑through.
14) Minors
Services for minors, if offered, require parent or legal guardian consent and may be limited by jurisdiction. Please contact us before booking.
15) Technology, Availability & Third‑Party Links
- We aim for high availability but cannot guarantee uninterrupted access.
- Third‑party platforms (video, payments, mailing) have their own terms and privacy practices; we aren’t responsible for their content or policies.
16) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Continued use means you accept the updated Terms.
17) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflicts of law principles. Before filing a claim, the parties agree to attempt good‑faith resolution by written notice and a 30‑day negotiation period. Either party may pursue a claim in small claims court where jurisdictional requirements are met. To the extent permitted by law, both parties waive any right to a jury trial.
